These terms and conditions of sale govern the sales of travel and tourist services (“the Services”) concluded between any customer (“the Customer”) and CIRCUITS VIETNAM COMPANY LIMITED (“Circuits Vietnam” or “Asiaplus Voyages”). They form an integral part of the sales contract.
Every Asiaplus Voyages customer acknowledges having read these terms and conditions of sale before placing their order. Therefore, placing an order implies full acceptance of these terms and conditions of sale without reservation.
2. SERVICES
Asiaplus Voyages therefore undertakes to provide the client with all services expressly included in the travel program agreed upon with the client.
The photos in the trip description are for illustrative purposes only and do not constitute a contractual agreement with Asiaplus Voyages.
3. VALIDITY PERIOD OF RATES
The prices offered by Asiaplus Voyages are valid for the period specified in the program, in the pricing, on the invoice or any other document distributed to the client.
During their validity period, these rates can only be adjusted in hardship cases where, due to an unforeseen change in the contract environment (significant fluctuation in the exchange rate, newly enacted tax, VAT increase, significant increase in transport costs, etc.), Asiaplus Voyages cannot properly carry out the travel program at the initial rates.
In these various cases, Asiaplus Voyages will send a reasoned request for adjustment to the client's itinerary, which the client may either accept or refuse. If the client refuses, Asiaplus Voyages reserves the right to cancel the program and will refund the client's deposit, less any bank charges.
4. ORDERING AND BOOKING SERVICES
If the customer wishes to place an order, they must confirm their agreement to Asiaplus Voyages, specifying the travel program proposal that suits them.
Asiaplus Voyages then proceeds to book all the services provided in the program and reserves the right to offer equivalent alternative solutions in the event of unavailability of one or more of the services provided (accommodation, domestic flights, train, etc.).
Once all bookings have been made, the final travel program will be sent to the client.
For the proper processing of the customer's order, it is the customer's responsibility to provide correct information to Asiaplus Voyages. Asiaplus Voyages is not liable if the customer's contact details are incorrect, such as passengers' names, email addresses, and bank details.
5. DEPOSITS
Registration more than 90 days before departure must be accompanied by a deposit amounting to 25% of the total price of the trip, according to the terms specified by Asiaplus Voyages.
However, a larger deposit may be required for bookings made less than 90 days before arrival or the start of the program, last-minute bookings, or when the airline requires immediate ticket issuance, or when the ground service provider requires full or partial payment upon ordering, or in the case of special offers, cruises, end-of-year holidays and high-volume events…. In these cases, the client will be notified of this additional condition.
Unless otherwise agreed with Asiaplus Voyages, failure to pay the deposit within 7 days of the client's receipt of the final itinerary may result in the cancellation of all booked services. The order will then be considered cancelled by the client.
6. PAYMENT OF THE BALANCE
The client must pay the balance of the trip, without reminder from us, from the start of the trip, unless otherwise indicated by Asiaplus Voyages.
The customer can, however, if they wish, make the payment before the start of the trip.
In the event of failure to pay the balance under the aforementioned conditions, the order will be deemed cancelled by the customer.
7. ORDER MODIFICATIONS BY THE CUSTOMER
The customer may request a modification of their order at any time, subject to payment to Asiaplus Voyages of any fees incurred as a result of the modification.
Asiaplus Voyages is obliged to respond to this type of request with the greatest diligence, within the limits of the availability of the required services and its capacity.
Postponing the arrival date is also considered a change.
Reducing the number of participants is not considered a change. It will result in cancellation penalties for participants who withdraw and a reassessment of fees for the remaining participants.
8. ORDER MODIFICATIONS BY ASIAPLUS VOYAGES
Asiaplus Voyages reserves the right to modify the services included in the final travel program in the following cases:
• The change is justified due to a force majeure event. In this case, the change may result in an additional charge to the client or a discount from Asiaplus Voyages.
• The modification is essential to ensure the client's safety and/or the quality of the trip. In these cases, any additional costs incurred will be borne by Asiaplus Voyages.
9. CANCELLATION OF ORDERS BY THE CUSTOMER
For groups of 1 to 8 participants, in all cases of trip cancellation by the client, the client agrees to pay the cancellation fees with the following penalty rates, unless otherwise agreed with Asiaplus Voyages:
• 10% of the total price of the trip, if its cancellation reaches Asiaplus Voyages within a period equal to or greater than 60 days before the start of the trip.
• 20% of the total trip price, if the cancellation reaches Asiaplus Voyages 60 to 31 days before the start of the trip.
• 35% of the total trip price, if the cancellation reaches Asiaplus Voyages 30 to 21 days before the start of the trip.
• 50% of the total trip price, if the cancellation reaches Asiaplus Voyages 20 to 14 days before the start of the trip.
• 60% of the total trip price, if the cancellation reaches Asiaplus Voyages 13 to 7 days before the start of the trip.
• 65% of the total trip price, if the cancellation reaches Asiaplus Voyages less than 7 days before the start of the trip.
• 100% of the total trip price, if its cancellation reaches Asiaplus Voyages after the start of the trip.
In the event of cancellation of a trip which had been postponed, the penalties are 25% of the total price of the trip, regardless of the cancellation period, unless otherwise indicated by Asiaplus Voyages.
Cancellation processing fees will be added to this price list:
• USD 100 for a trip of 8 days or less.
• USD 150 for a trip lasting more than 8 days.
The total amount of cancellation fees (fees in % + flat amount) cannot exceed the total cost of the trip.
In the event of a trip cancellation, Asiaplus Voyages will deduct the penalty amount from the deposit paid by the client and refund the remaining balance, if applicable, by bank transfer. The client will be responsible for all bank charges.
For all groups of 9 or more participants, or for programs with special requests (hotels, boats or airlines…), please consult your Asiaplus Voyages travel advisor for more information regarding special sales conditions for large groups and/or special services.
10. CANCELLATION OF ORDERS BY ASIAPLUS VOYAGES
Asiaplus Voyages reserves the right to cancel the trip, in whole or in part, in the event of force majeure. These are unforeseeable, unavoidable, and irresistible events that make travel impossible or dangerous for the client, such as: war or threat of war, riots, natural disasters, port blockades, looting, fires and any terrorist activity, severe weather, epidemics, quarantines, or any similar event.
In all these cases of cancellation, Asiaplus Voyages will endeavor to reimburse those registered for the travel program, less (if applicable) additional costs incurred by this new situation, cancellation fees charged by hotels, airlines or any other service provider, and finally, bank charges, but participants will under no circumstances be entitled to compensation.
11. CUSTOMER'S OBLIGATION
Before embarking on their trip, it is the client's responsibility to ensure that they meet the required conditions in terms of:
• Passport (minimum validity of 6 months after return, at least two blank pages,…).
• Physical condition, vaccinations, preventative treatments…
• Visa (required for Vietnam, Laos and Cambodia… depending on the client’s nationality and the length of their stay).
Asiaplus Voyages can, upon request, assist the client in the process of obtaining their visa.
12. INSURANCE
No insurance or repatriation assistance is included in the price of our trips.
Asiaplus Voyages is an inbound tour operator and we do not deal with insurance and assistance contracts.
Anyone participating in a trip organized by Asiaplus Voyages must have international travel insurance that covers at least medical expenses and repatriation. It is therefore recommended that you purchase this insurance in your home country before the start of your trip.
However, we can fully play the role of intermediary between your insurer and our service providers.
Please inform us of your contract with your insurer if needed.
During the trip, travelers must comply with the rules announced by the guide or any other Asiaplus Voyages agent. These rules are designed to ensure client safety and the quality of the services provided by the travel program.
Asiaplus Voyages undertakes to provide on site all the necessary and useful assistance to the client in the event of an incident covered by the insurance, and in particular to assist the client in completing the administrative formalities with the local authorities and the insurer.
13. LIMITATION AND EXCLUSION OF LIABILITY
Asiaplus Voyages is committed to providing the client with all the services agreed upon with the client and included in the travel program.
The client remains responsible for all their actions:
– Any activity by the individual that is not part of the travel program or any violation of the law of the host country by the individual is not the responsibility of Asiaplus Voyages.
– Any cancellation of the travel program due to legal issues will deprive the client of any right to a refund from Asiaplus Voyages.
Asiaplus Voyages is responsible to the client as an intermediary between the latter and the various service providers (airlines, hotels, carriers, restaurants, boats, etc.) and must therefore ensure a certain quality of services, but Asia Plus cannot be confused with these various providers, who, in any case, retain their own responsibility.
Asiaplus Voyages cannot under any circumstances be held liable for an event that would constitute a case of force majeure.
14. UNUSED BENEFITS
Asiaplus Voyages does not refund services included in the program but not used by the client. However, if the trip is interrupted during its course due to the client's health, Asiaplus Voyages will make every effort to obtain a partial or even full refund from the service providers for the cancelled services.
15. COMPLAINTS AND DISPUTE RESOLUTION
Any complaint relating to the performance of any of the services included in the program must be addressed in writing to Asiaplus Voyages within a maximum of 21 days from the end of the trip.
However, since most problems can be quickly resolved if Asiaplus Voyages is aware of them, any dispute between the client and Asia Plus should be settled first on site through amicable negotiation.
Should Asiaplus Voyages decide to pay compensation to a client, this compensation may under no circumstances exceed the price of the trip, excluding airfare, charged by Asiaplus Voyages. This applies only if the entire trip went wrong and the client received no satisfaction.
In all other cases, Asiaplus Voyages reserves the right to offer or not offer compensation at its sole discretion.
If no amicable solution is found, the International Arbitration Centre (VIAC) at the Vietnam Chamber of Commerce and Industry (VCCI) will be the only body deemed competent to settle the dispute.
16. PAYMENT METHOD
Asiaplus Voyages accepts payments in Euros, US Dollars or Vietnamese Dong.
16.1. Secure online payment via Onepay
The customer can pay by bank card via Onepay, a secure online payment system, subject to a 3.3% bank fee for Visa and MasterCard cards…
16.2. Bank transfer
The customer can also pay by bank transfer.
Asiaplus Voyages' bank details will be provided to the client upon conclusion of the service contract.
Bank charges, determined by the client's bank and Asiaplus Voyages' bank, are the responsibility of the client.
Upon receipt of a deposit or balance payment from the client, Asiaplus Voyages will issue an acknowledgement of receipt which will be given to the client before or upon arrival of the travelers in Vietnam.
16.3. Electronic payment terminal
Payment by bank card via an electronic payment terminal, more commonly known as a "card machine", is only possible for settling the balance of the trip at the Asiaplus Voyages office in Hanoi.
The following credit cards are accepted: Visa, MasterCard, American Express, JCB and Diners Club.
Payment is made at the Asiaplus Voyages office in Hanoi, subject to bank charges payable by the client. Unless otherwise specified by Asiaplus Voyages, these charges amount to 3% of the amount due for Visa and MasterCard, 4% for American Express, and 3.3% for JCB and Diners Club cards.
16.4. Cash payment
Cash payments can be made at the Asiaplus Voyages office in Hanoi or directly to its agents. Cash payments are free of charge and are recommended.
